These Terms govern your access to and use of eugenebleecker.com and the paid consulting calls and related services provided by Eugene Bleecker, 108 Performance, and their affiliates, subsidiaries, and related entities (the “Services”). By using the Services, you agree to these Terms and the Privacy Policy.
We operate in the State of Tennessee and throughout the United States. You must be at least 13 to use online Services and of legal age to form a binding contract (or have a parent/guardian contract on your behalf and attend). You are responsible for your account, credentials, and all activity under it.
You authorize us and our payment processor (e.g., Stripe or similar) to charge your selected payment method for all fees and taxes shown at checkout. If you have a billing issue, contact us first at info@eugenebleecker.com to attempt resolution before initiating a chargeback.
Unless expressly stated in writing, Services consist of live advisory/consulting conversations and optional recap notes. We do not provide ongoing implementation, management, or professional services beyond the booked session(s). Results are not guaranteed.
The Services are informational/educational and do not constitute legal, medical, financial, or tax advice. You are solely responsible for your decisions and outcomes; consult licensed professionals for advice specific to your situation.
Default: sessions are not recorded. Recording requires mutual, explicit written consent for each session and will specify who receives the file, storage duration, and permitted uses. Unauthorized recording is prohibited.
Both parties will keep each other’s non-public information confidential and use it only to deliver/receive the Services. We may use anonymized and aggregated learnings to improve our frameworks and Services.
You will not use the Services to violate laws, infringe rights, transmit malware, attempt unauthorized access, interfere with the site, or scrape/reverse-engineer except as permitted by law.
With your separate consent, we may feature your testimonial, logo, first name/initial, role, and/or case study. You can revoke consent for future uses by contacting info@eugenebleecker.com.
The Services may integrate with third-party platforms (booking, payments, video, analytics, messaging). Your use of those platforms is subject to their terms and privacy policies. We are not responsible for their acts or omissions.
By providing contact details, you agree to receive transactional communications about your bookings. Marketing communications require opt-in and can be withdrawn at any time. SMS: Message & data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help.
We may suspend or terminate access if you violate these Terms or use the Services in a way that risks harm. You may stop using the Services at any time; fees already paid are non-refundable unless we state otherwise in writing.
The Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law.
To the fullest extent permitted by law, our total liability for any claim arising from or related to the Services will not exceed the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, reliance, or punitive damages.
You agree to defend, indemnify, and hold harmless us and our affiliates from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.
Before filing a claim, the parties will attempt good-faith informal resolution. If unresolved, disputes will be submitted to binding arbitration on an individual basis in Tennessee (seat and venue), administered by a reputable arbitral forum, with one arbitrator. Small-claims actions in Tennessee remain permitted. No class actions or representative proceedings.
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules.
We are not responsible for delays or failures due to events beyond our reasonable control (e.g., outages, provider failures, natural disasters, strikes, war, law changes).
We may update these Terms. Changes are effective when posted with the updated date above. Continued use after changes means you accept the updated Terms.
